Welcome to Taciturn. These terms explain what you can expect when you visit our website or play Taciturn in your browser, and what we ask of you in return.

We’ve kept them as straightforward as possible. If you have questions, contact us at support@taciturn.ca.

1. What these terms cover

These terms apply to taciturn.ca and the browser version of Taciturn available through the website. By accessing or using these services, you agree to follow these terms to the extent permitted by applicable law. If you do not agree, please stop using the website and browser game.

The iOS version of Taciturn is distributed through Apple’s App Store and is governed by Apple’s Standard Licensed Application End User License Agreement, unless a different agreement is expressly provided with the iOS app. App Store purchases are handled through Apple under its applicable terms. These website terms do not replace those agreements.

2. Enjoying Taciturn

You're welcome to play Taciturn for personal, non-commercial enjoyment and use the website for its intended purposes. You do not need to register an account with us to play the browser version.

Please use the website responsibly. In particular, don't:

• Attempt to disrupt the website, its hosting, or other visitors' access.
• Try to gain unauthorized access to systems, services, or information.
• Use automated requests or other methods that place an unreasonable burden on the service.
• Copy, redistribute, sell, or represent Taciturn's proprietary game assets or website content as your own without permission, except where permitted by law or an applicable third-party licence.

These restrictions do not limit rights you have under applicable law, including lawful security research, permitted uses of copyrighted material, or rights granted by open-source licences.

3. Ownership and third-party materials

Taciturn's original software, artwork, text, visual presentation, and other content are protected by applicable intellectual property laws. Using the website doesn't transfer ownership of this material to you.

Some fonts, libraries, and other materials belong to their respective creators and are used under their own licences. Those licences continue to apply to the relevant materials, and nothing here takes away rights they give you. See our Licences & Acknowledgements page for details.

4. Browser storage and saved games

The browser version may save your settings, statistics, and game progress locally in your browser. That makes it easier to continue playing, but local information may be lost if you clear website data, use a different browser or device, or your browser removes stored information.

We cannot guarantee that locally saved data will always be preserved or recoverable. If a feature or update changes how data is stored, we'll make reasonable efforts to avoid unnecessary loss.

5. Availability and changes

We aim to keep Taciturn working well, but the website and browser game may occasionally be interrupted by maintenance, technical problems, hosting issues, or circumstances beyond our control.

We may improve, update, change, or discontinue features or the website itself. Where practical, we'll try to communicate significant changes in advance. Nothing in this section limits any rights you may have under applicable law.

6. No promise of uninterrupted service

We provide Taciturn with care, but cannot promise that the website will always be available, free from errors, or compatible with every browser or device.

To the extent permitted by law, the website and browser game are provided on an “as available” basis. We do not exclude any warranties, guarantees, or other protections that cannot lawfully be excluded, including applicable consumer rights.

7. Responsibility and liability

To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of the website or browser game, such as lost locally stored game progress, where such losses could not reasonably have been prevented.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud, intentional misconduct, or rights and remedies protected by consumer legislation. If you believe something has gone wrong, please contact us so we can try to help.

8. Links to other services

The website may link to Apple's services, software projects, font creators, or other third-party websites. These services are operated by their respective providers and may have their own terms and privacy policies. We don't control their content or availability.

9. Privacy

Our Privacy Policy explains how information is handled when you play, browse the website, or contact support. Please review it separately from these terms.

10. Changes to these terms

We may update these terms to reflect changes to Taciturn, the website, or legal requirements. We'll publish the updated terms here with a new date. When a material change requires additional notice or agreement under applicable law, we'll provide it.

Changes will apply going forward and will not take away rights you already have under applicable law.

11. Applicable law

These terms are intended to be interpreted under the laws of British Columbia and the applicable federal laws of Canada, except where mandatory laws in your place of residence provide otherwise. This provision does not prevent you from using consumer rights or legal remedies available to you under applicable law.
